Terms of Service

These Terms of Service (“Terms”) govern your use of Motion (“Motion”, “the App”, “we”, “our”), a software product owned and operated by Omital Group LLC. By creating an account or using Motion, you agree to these Terms. If you do not agree, you may not use the Services.
1. Who We Are

2. Eligibility and Accounts
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Motion.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity performed under your account
- Ensuring information you provide is accurate and up to date
We may suspend accounts that violate these Terms or pose security risks.
3. Plans and Pricing
Motion offers two main plans:
3.1 Free Plan
The Free plan provides access to the core Motion experience with limitations. Certain advanced editing features, exports, or AI-powered capabilities may require upgrading to Premium.
3.2 Premium Plan
Premium unlocks additional features and enhanced functionality.
Pricing:
- $6/month billed yearly, or
- $12/month billed monthly
We may modify pricing in the future, but any changes will be communicated in advance and will not retroactively affect an existing billing cycle.
3.3 Unlimited Updates
Both Free and Premium users receive all software updates at no additional cost.
4. Payments and Billing
Payments are securely processed by Stripe, Inc. (“Stripe”). We do not store full payment card data.
By subscribing, you authorize us and Stripe to charge your selected payment method on a recurring basis until you cancel.
4.1 Subscription Renewal
Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
4.2 Refunds
Motion offers a 7-day refund window for new subscriptions or renewals.
If approved, we initiate a refund through Stripe.
Actual refund posting times are determined solely by Stripe and your bank, not by Motion or Omital Group.
Refunds are not provided for:
- Partial billing cycles
- Failure to use the service
- Charges older than 7 days
5. Acceptable Use
When using Motion, you agree not to:
- Reverse engineer, decompile, or attempt to extract source code
- Use the software to develop competing products
- Circumvent or remove licensing, locking, or activation mechanisms
- Upload illegal, harmful, or infringing content
- Use Motion for unlawful purposes or in ways that violate the rights of others
We may suspend or terminate accounts for misuse.
6. User Content
Motion allows you to create, edit, and export recordings, videos, or other content (“User Content”).
You retain ownership of your User Content.
By using Motion, you grant us a limited license to process and store your data solely to operate the App.
We do not use your content to train AI systems or for unrelated purposes.
You are responsible for ensuring your content complies with applicable law.
7. Software License
We grant you a non-exclusive, non-transferable, revocable license to install and use Motion for personal or business purposes, subject to these Terms.
Motion and all associated intellectual property remain the exclusive property of Omital Group LLC.
8. Availability and Updates
We strive to keep Motion available and functioning reliably, but:
- Downtime may occur due to maintenance, updates, or technical issues
- Features may change, be added, or be removed over time
We provide no guarantee of uninterrupted service
Updates are provided automatically and at no extra cost.
9. Termination
You may stop using Motion at any time.
We may suspend or terminate your access if:
- You violate these Terms
- You engage in fraudulent or harmful behavior
- We are required to comply with legal or regulatory obligations
Upon termination, your license to use the software ends.
10. Limitation of Liability
To the fullest extent permitted by law:
- Motion and Omital Group LLC are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, data, profits, business interruption, or anticipated savings.
- Our total liability for any claim arising out of or related to the Services will not exceed the amount you paid to us in the 3 months prior to the event giving rise to the claim.
- The Services are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, reliability, accuracy, or availability.
Some jurisdictions do not allow certain liability limitations; in those cases, these limitations apply only to the extent permitted.
11. Indemnification
You agree to indemnify and hold harmless Omital Group LLC, its employees, affiliates, and contractors from any claims, liabilities, damages, or expenses arising from:
- Your misuse of Motion
- Your User Content
- Your violation of these Terms
12. Governing Law
These Terms are governed by and interpreted under the laws of the State of Florida, USA, without regard to conflict-of-law principles.
Any disputes will be resolved exclusively in the courts located in Miami-Dade County, Florida.
13. Changes to These Terms
We may update these Terms periodically.
When changes occur, we will update the “Last Updated” date above.
Significant changes will be communicated through the Motion platform or via email.
Continued use of Motion after changes constitutes acceptance of the updated Terms.
